Insurer

You can choose from Buildings and Buildings and Contents Insurance. Your intermediary will provide you with details of the cover you have chosen, and will confirm the sums insured that you have requested at the time of quotation.
Cover specific features and benefits
Section One: Buildings
Up to 20% of the buildings sum insured for loss of rent or costs for alternative accommodation.
Up to £1000 for water charges payable following accidental damage to domestic water or heating system.
Up to £2 million liability cover as the owner of your present and previous homes (up to 7 years after you sold it.)
Section Two: Contents
Up to 20% of the contents sum insured for loss of rent or costs for alternative accommodation.
Up to £1000 for water charges payable following accidental damage to domestic water or heating system.
Up to £5 million for liability for accidents to domestic employees for any one event (plus any agreed costs and expenses.)

Section One: Buildings
If the private residence is occupied partly or wholly by tenant(s) in the following categories, we will not pay the first part of every claim as shown, other than claims for subsidence, heave or landslip where the excess will be £1000 (or as specified by endorsement.)
Category 1 - Private £100.00

Category 3 - Department of Social Services £150.00
Category 4 - Asylum seeker £250.00
Section Two: Contents
The first £100 of every claim (or as specified by endorsement)
More than one excess may apply to a claim, but details of all excesses may be shown in your insurance document (or in your schedule.)
Period of insurance
The insurance offered is a 12-month contract. The insurance may be renewed each year, but renewal will be subject to the terms and conditions that apply at the time of the renewal.
Cancellation
You may cancel the insurance at any time by sending us written notice. The charges that will apply are detailed in the general conditions section of the insurance document.
Your right to change your mind
You may cancel the insurance, without giving reason, by sending us written notice and returning the insurance documents within 14 days of it starting or, (if later), within 14 days of receiving the insurance documents. We will make a charge equal to the period of cover you have had, but this charge will be subject to a minimum of £25 + insurance premium tax (IPT).
How to claim
If a claim or possible claim occurs you must report it to us as soon as possible. Please phone our 24-hour helpline on 0870 240 1563
Complaints
If you have any cause to complain about our insurance, or us, please contact your intermediary who administers the insurance on our behalf.
Having contacted your adviser, if you are still not satisfied with the way a complaint has been dealt with, you should write to the Chief Executive of Equity Red Star at 52 Leadenhall St., London EC3A 2BJ. When you do this quote your insurance document number as it will help us to deal with your complaint promptly.
After this action, if you are still not satisfied with the way a complaint has been dealt with you should refer your case to the Complaints Department at Lloyds at Policyholder and Market Assistance, Lloyds Market Services, 1 Lime St., London EC3M 7HA.
Having followed this procedure, your complaint can be referred to the Financial Ombudsman Service (FOS) at The Financial Ombudsman Service, South Quay Plaza II, 183 Marsh Wall, London E14 9SR.
(These procedures do not affect your right to take legal action if necessary)
Financial Services Compensation Scheme (FSCS)
If Equity Red Star is unable to meet its liabilities under the insurance, you may be entitled to compensation from the FSCS.
The first £2000 of a claim is protected in full and 90% of the remainder of the claim will be met. You can get further information from us or from the Financial Services Authority (FSA).
Law applying to this insurance
Unless we have agreed otherwise with you, English law will apply to this insurance.

Policy Summary
Up to 20% of the contents sum insured for loss of rent or costs for alternative accommodation. Some important facts about the Professional Fees policy are summarised below. This summary does not describe all of the terms and conditions of the policy, so you will need to take time to read the insurance policy wording to make sure that you understand the cover that it provides. All references below to the cover provided are contained within the full policy wording. Please note that a full policy wording is available for your inspection upon request.

The policy is designed to cover the cost of professional fees charged by a claims handler, solicitor or accountant following a specific occurrence, provided that cover for that occurrence is detailed within the policy wording and is not specifically excluded within the policy schedule issued.

The limit of indemnity provided will be shown on the policy schedule issued and is limited to £25000 in any one claim or any one period of insurance.

Rent Arrears Pursuit The pursuit of Rent Arrears which commenced during the period of insurance.  
Eviction The eviction of anyone in the property without your permission.  
Legal Defence The defence of civil or criminal proceedings in respect of any act or omission by you arising from your ownership or management of the property.

Significant & unusual exclusions or limitations
The policy will exclude claims where the incident falls outside of the scope of cover provided by the policy wording or where this is subject to a specific exclusion or limitation. Please refer to the policy wording for full details. The most significant or unusual exclusions or limitations are outlined below.
Other than the excess (first amount of any claim you are required to pay) shown under the relevant section of cover listed above, unless otherwise shown on the policy schedule, no additional excess applies.
You must obtain or have obtained and be able to produce a satisfactory credit reference prior to the granting of the tenancy.
If you can convince us that there are sensible prospects of being successful in your claim and that it is reasonable for Professional Fees to be paid we will take over the claim on your behalf appoint a specialist of our choice to act on your behalf.
We may limit the Professional Fees that we will pay under the policy where we consider it is unlikely a reasonable settlement of the claim will be obtained, or the potential settlement amount of the claim is disproportionate compared with the time and expense incurred in pursuing or defending the claim.
Where it may cost us more to handle a claim than the amount in dispute we may at our option pay to you the amount in dispute which will then constitute the end of the claim under the policy.
If Legal Proceedings have been agreed by us you may at that stage decide to nominate and use your own solicitor or indeed, you may wish to continue to use our own specialists.
If you decide to nominate your own solicitor we must agree this in advance and you will be responsible for any Professional Fees in excess of those which our own specialists would normally charge us (Details are available upon request).
At conclusion of the claim if you are awarded any costs (not your damages), these must be paid to us.
Please note that if you should engage the services of a solicitor prior to making contact with us any costs that you incur are not covered by this Insurance.
This is a policy where you must notify us during the period of insurance and within 30 days of any circumstances which may give rise to any claim under the policy. Failure to do so could mean that we decline to pay a claim for your professional fees.
The jurisdiction and territorial limits of the policy is The United Kingdom.
In the event that you make a claim under this policy which you subsequently discontinue due to your own disinclination to proceed, any legal costs incurred to date will become your own responsibility and will be required to be repaid to the insurer.
The following circumstances are not covered by the policy:
Any incident which occurs within the first 90 days of the first period of insurance where the tenancy agreement commenced before the policy started.
Any Insured Incident arising out of a tenancy agreement which does not fall within the definition of Tenancy Agreement.
A dispute relating to service charges or any compensation payment to a tenant.
The defence of dilapidation claims that fall within Small Claims limits.
The Tenancy Agreement having been granted without first obtaining the requisite consent or licence.
Claims arising out of rent registration or reviews, purchasing the freehold of the Property, rent tribunals, land tribunals or rate tribunals unless defending action bought against you by the Tenant.
Duration of the contract
The cover provided by the policy is normally for a twelve month period. Where this is altered, it will be clearly shown within the quotation provided and policy schedule subsequently issued.
Cancellation
We wish you to be happy with the cover provided by your policy. However you have the right to cancel the policy within 14 days of receiving the policy documents without giving reason. If you chose to cancel, we will refund your premium after first (at our discretion) charging for the cover provided from the date of commencement of the contract until the date of cancellation and any helpline costs incurred.
Claims address
The person insured by the policy should report immediately (and in accordance with the policy terms and conditions no later than 30 days after the occurrence) any incident which may give rise to a claim under the policy. Failure to do so could mean that we decline to pay a claim under the policy. The telephone number for the reporting of a claim is contained within the policy schedule. A claim form will be dispatched for completion by the insured person and return to the address shown below. If you wish to make a claim in writing, this must be made in person by the Insured Person seeking cover under the policy issued. Please note that we will not enter into dialogue or correspond with anyone other than the Insured Person or the Insured Person’s personal representatives (following death or serious incapacity) in relation to the notification and subsequent handling of a claim. Complaints procedure
In the event of a complaint arising under this Insurance, you should in the first instance write to the Agent who arranged this Insurance on your behalf.

If the matter remains unresolved you should write to the Managing Director of Legal Insurance Management Ltd at the above address.

If the matter still remains unresolved thereafter you can then write to the Insurers whose details are shown within the policy schedule.

If it is not possible to reach an agreement, you may have the right to make an appeal to the Financial Ombudsman Service.

This also applies if you are insured in a business capacity but have a group annual turnover of less than £1 million, or are a charity with an annual income of less than £1 million, or are a trustee of a trust with a net asset value of less than £1 million.

Compensation scheme
AXA Insurance UK plc are covered by the Financial Services Compensation Scheme (FSCS). You may be entitled to compensation from the scheme, if they cannot meet their obligations. This depends on the type of business and the circumstances of the claim. Most insurance contracts are covered for 100% of the first £2,000 and 90% of the remainder of the claim.

Empty/Unoccupied Property
We must be notified as soon as possible but in any event within 90 days whenever a Property becomes empty or unoccupied Failure to comply with any part of this section could invalidate a claim.
We will not pay for any claim arising under paragraphs b) (Theft) c) (Riot) d) (Malicious Damage) h) (Escape of Water) i) (Damage to Water Installations) of the Perils Insured and paragraph d) (Glass) of the Extensions if any Property(s) is/are left without an occupant for more than 14 consecutive days unless:
(i) The Premises are inspected at least once during each 14 days by You or your appointed representative
(ii) The water, gas and electricity supplies are turned off at the main and the water system drained except where required to be maintained for central heating
(iii) If the central heating system is left in operation it should be set for a minimum continual temperature of 13°C
(iv) Door and door locks identified as being suitable for external use must be fitted and used at all times
(v) all refuse and waste materials are removed from the interior of the premises and no accumulation of refuse and waste be allowed in the adjoining yards or spaces owned by You
(vi) The premises are unoccupied for no more than 30 days in any period of insurance due to annual leave
Other terms and conditions may apply, dependent on circumstance.
Your Cancellation Rights
You are entitled to cancel your insurance policy at any stage during the policy term. You are entitled to a period of 14 days in which to consider the content of your insurance policy, and the extent of the cover therein. Cancellation of your policy within 14 days is therefore subject to a full refund
Provided that there have been:
no claims made under the Policy for which we have made a payment
no claims made under the Policy which are still under consideration
no incident likely to give rise to a claim but is yet to be reported to Us
Cancellation after 14 days will be subject to the normal terms and conditions of the policy wording, and will be refunded pro-rata, less 15% of the total cost of the insurance cover
If a claim has been submitted or there has been any incident likely to give rise to a claim during the current Period of Insurance, no refund for the unexpired portion of the premium will be given.
Claim Notification
In the event that you need to make a claim under your Policy, you should telephone the Rentguard claims line on 0208 587 1060. Claims must be submitted within 30 days of the incident.
Making Yourself Heard
Any complaint you may have should in the first instance be addressed to your Insurance Adviser, then claim office or helpline as applicable. If you are not satisfied with the way in which your complaint has been dealt with, you should write to the Customer Care AXA Insurance.
If the complaint is still not resolved, you can approach the Financial Ombudsman Service. The Ombudsman will only consider complaints if:
We have provided you with written confirmation that our internal complaints procedure has been exhausted
Your business has a turnover of less than £1,000,000
Referral to the Financial Ombudsman will not affect your right to take legal action.

Financial Services Compensation Scheme (FSCS)
Rentguard is covered by the FSCS, which is triggered when an authorised firm goes out of business. In this unlikely event you may be entitled to compensation from the scheme. Compensation under the scheme for:
Compulsory insurance is covered in full
Non compulsory insurance is protected in full for the first £2,000 and 90% of any amount above the threshold.
